Alimony

Please go through following things to understand alimony;

  1. This is a relief granted for life.
  2. It is advisable to maintain a dairy for both husband / wife with details of amount received, any shortfall, any skipped payments, arrears, etc., so that both husband / wife can be accountable.
  3. A property can be secured for the payment, with a consequence of assigning charge on the property if there is a failure to pay.
  4. The properties presented to court during petition will also be considered in final judgment and decree, the assets which would belong to both husband and wife jointly.
  5. This could be in the nature of monthly or periodical.
  6. Under extraordinary circumstances, these orders can be revised.

The applicable laws for Alimony are as follows;

1. Section 25 of the Hindu Marriage Act 1955.

2. Section 37 of the Special Marriage Act, 1954.

3. Section 36, 37, and 38 of the Divorce Act, 1869.

4. Section 40 of Parsi Marriage Act 1936.
