Mutual Consent Divorce

One of the quickest and fastest way to get a divorce in Bangalore is through mutual consent and it is permissible by law under following conditions, 

      1. Mutual consensus among parties to dissolve the marriage is mandatory.
      2. Husband and wife are living separately for more than one year and they cannot cohabit together and agreed to dissolve the marriage.
      3. On the motion of both parties made after six months from the date of presentation of the petition and before eighteen months from the date of presentation. 

    If court is satisfied after making inquiry and the averments in the petition are true, a decree of divorce dissolving marriage from the date of decree.

    1. Section 13B(2) of the Hindu Marriage Act, 1955.
    2. Section 28 of the Special Marriage Act, 1954.
    3. Section 10A of the Divorce Act, 1869.
    4. Section 32B of the Parsi Marriage Act 1936.
