Interim Maintenance for Child in Proceedings

This falls under the category of interim relief granted to parent who has custody of child. While a divorce case is in progress, when the court considers that the parent who has custody of child is unable to bear the expenses with maintenance order passed or while the proceedings are in progress, then it can pass an order granting maintenance. If the order is passed earlier then, revise or modify the order to accommodate expenses of child including school or college fees, health, and other expenses in addition or together with the maintenance.
Applicable laws for Interim Maintenance of child in India:
The applicable laws are as follows;
1. Section 24 and 25 of the Hindu Marriage Act, 1955.
2. Section 36 and 37 of the Special Marriage Act, 1954.
3. Section 36 and 37 of the Divorce Act, 1869.
4. Section 39 and 40 of Parsi Marriage Act 1936.
